To be clear, and on a personal level, having witnessed death penalties being carried-out, I am not a supporter of the Death Penalty – as neither was Karl Marx (although Marx did believe a worker possessed the right to defernd him or herself). This is an ideal position – but we do not live in an ideal world. Lenin agreed with Marx – but interpreted this to mean that the working-class should not kill the working-class – but executing class enemies was acceptable (hence only “political” crimes attracted the Death Penalty in the USSR – and not “Civil” crimes – although the latter would change with Khrushchev). Believe it or not, after all the Nazi War Criminals had been tried and executed in the USSR and Communist Bloc – Joseph Stalin abolished the Death Penalty throughout the USSR (for good) in 1948. Khrushchev, being a tyrannical Trotskyite, copied the US practice of putting to death its own civil population for crimes, and although exempting political crimes, permitted the Soviet Courts to inflict the Death Sentence on any civilian for any capital crime (c. 1959). Cuba also executed its political enemies (often on film) – but so did the US and its numerous proxies (see South Korea and Vietnam – but also Liberia – and of course ISIS and Al Qaeda, etc). Israel murders directly in accordance with Biblical scripture – so no one’s hands are clean. Interestingly, China is attempting to move away from the “Death Penalty” with the “Suspended Death Penalty” – but that did not apply in this case, due to the amount of money involved and the scope of the corruption. Yang Youlin caused tremendous suffering to the ordinary Chinese people under the guise of the authority of the CPC – and so he must pay the highest price for this betrayal. Where in the West capitalist greed is encouraged and rewarded – this is not so in China. Whatever the case, Marxist-Leninist regimes tend to move in the direction of “away” from the Death Penalty once conditions in society are so orientated. ACW (7.7.2026)

According to newspaper reporter Zhang Hao, on July 6th, 2026 the Changzhou Intermediate People’s Court in Jiangsu Province publicly pronounced the first-instance verdict on Yang Youlin, former Executive Deputy Director of the Nanjing Economic-Technological Development Zone Administrative Committee, in the case of bribery, embezzlement, bribery, misappropriation of public funds, abuse of power, and money laundering. The defendant Yang Youlin was sentenced to death for bribery, deprived of political rights for life, and all personal property confiscated; He was sentenced to eleven years and six months in prison for embezzlement and fined 1 million yuan; He was sentenced to eleven years in prison for bribery and fined 1 million yuan; He was sentenced to five years in prison for embezzlement of public funds; He was sentenced to four years in prison for abuse of power; He was sentenced to six months in prison for money laundering and fined 100,000 yuan, sentenced to death, deprived of political rights for life, and all personal property confiscated. The confiscated criminal proceeds and proceeds of Yang Youlin were lawfully turned over to the state treasury, with any shortfall continuing to be recovered.

Upon trial, it was found that from 1993 to 2023, the defendant Yang Youlin took advantage of his positions as Manager of the Municipal Engineering Company of Nanjing Jiangning Economic and Technological Development Corporation, Deputy Director of the Administrative Committee of Nanjing Jiangning Economic and Technological Development Zone, Deputy Director, Executive Deputy Director of the Administrative Committee, Inspector of the Administrative Committee, and Development Consultant for Nanjing Jiangning Riverside Economic Development Zone to help relevant units and individuals undertake projects, business operations, land transfers, and illegally accepted property totaling more than 2.214 billion yuan. In addition, Yang Youlin also used his position to conspire with others to fraudulently obtain fiscal funds; Giving property to state officials to seek improper benefits; abused his authority and illegally arranged land demolition and construction, causing a negative social impact; Illegally refunding land transfer fees, causing economic losses to the state, and other acts.

The Changzhou Intermediate Court held that Yang Youlin’s actions constituted the crimes of fraud, embezzlement, bribery, misappropriation of public funds, abuse of power, and money laundering, and should all be punished according to law, with multiple charges concurrent. Yang Youlin accepted bribes with an exceptionally large amount, the circumstances of his crimes were particularly serious, and the social impact was particularly severe, causing significant losses to the interests of the country and the people. His crimes were extremely serious and he should be sentenced to death according to law. Although Yang Youlin’s exposure of others’ criminal acts was verified to be true and he demonstrated meritorious service, considering the facts, nature, circumstances, and social harm of his bribery crime, it is insufficient to warrant a lighter punishment. The court therefore rendered the above judgment.

It is reported that the Changzhou Intermediate Court held public hearings for the case on March 18 and April 28. During the trial, the procuratorate presented relevant evidence, and defendant Yang Youlin and his defense counsel conducted cross-examination. Under the courtroom’s presidement, both sides fully expressed their opinions. Yang Youlin made his final statement and admitted guilt and expressed remorse in court. More than 30 people’s congress deputies and people from all walks of life attended the trial.

本报讯 记者张昊 7月6日，江苏省常州市中级人民法院一审公开宣判南京经济技术开发区管委会原常务副主任杨有林受贿、贪污、行贿、挪用公款、滥用职权、洗钱案，对被告人杨有林以受贿罪判处死刑，剥夺政治权利终身，并处没收个人全部财产；以贪污罪判处有期徒刑十一年六个月，并处罚金人民币一百万元；以行贿罪判处有期徒刑十一年，并处罚金人民币一百万元；以挪用公款罪判处有期徒刑五年；以滥用职权罪判处有期徒刑四年；以洗钱罪判处有期徒刑六个月，并处罚金人民币十万元，决定执行死刑，剥夺政治权利终身，并处没收个人全部财产。对追缴在案的杨有林犯罪所得财物及孳息依法上缴国库，不足部分继续追缴。

经审理查明：1993年至2023年，被告人杨有林利用担任南京江宁经济技术开发总公司市政工程公司经理，南京江宁经济技术开发区管委会副主任，南京经济技术开发区管委会分管领导、副主任、常务副主任，南京经济技术开发区管委会巡视员，南京江宁滨江经济开发区发展顾问等职务上的便利，为相关单位和个人在承接工程、企业经营、土地出让、资金周转等事项上提供帮助，非法收受财物共计折合人民币22.14亿余元。此外，杨有林还有利用职务上的便利，伙同他人骗取财政资金；为谋取不正当利益，给予国家工作人员财物；滥用职权，违规安排土地拆迁建设，造成恶劣社会影响；违规退返土地出让金，造成国家经济损失等行为。

常州中院认为，被告人杨有林的行为构成受贿罪、贪污罪、行贿罪、挪用公款罪、滥用职权罪、洗钱罪，均应依法惩处，并予数罪并罚。杨有林受贿数额特别巨大，犯罪情节特别严重，社会影响特别恶劣，给国家和人民利益造成特别重大损失，罪行极其严重，依法应当判处死刑。虽然杨有林揭发他人犯罪行为，经查证属实，具有立功表现，但综合其所犯受贿罪的事实、性质、情节和对于社会的危害程度，不足以对其从轻处罚。法庭遂作出上述判决。

据悉，常州中院于3月18日、4月28日公开开庭审理了该案。庭审中，检察机关出示了相关证据，被告人杨有林及其辩护人进行了质证，控辩双方在法庭的主持下充分发表了意见，杨有林进行了最后陈述，并当庭表示认罪悔罪。人大代表和各界群众30余人旁听了庭审。
