On September 28th, 2016, the Intermediate People’s Court of Bazhong City ruled in its final judgment – dismissing Wu Zhenghe’s (吴正和) appeal – and upheld the original judgment. On August 9th, the People’s Court of Pingchang County, Bazhong City, Sichuan Province, sentenced Wu Zhenghe to three years in prison for using a cult organization to break the law.
Wu Zhenghe – male and of the Han nationality – was born in October 1954 in Pingchang County, Sichuan Province. On January 28th, 2002, Wu Zhenghe was sentenced to four years in prison by the Pingchang County People’s Court for committing crimes of using a cult organization to break the law. In February 2013, due to the distribution of Falun Gong Cult materials, he was administratively detained by the Pingchang County Public Security Bureau for 13 days. From June to August 2015, more than 10 Falun Gong Cult practitioners were charged with indictments for producing criminal materials, which were sent to the Supreme People’s Court and the Supreme People’s Procuratorate. On the morning of January 7th, 2016, Wu Zhenghe was caught preaching Falun Gong Cult false propaganda in the street of Xixing Town, Pingchang County, whilst distributing Falun Gong Cult materials to vulnerable individuals. The Pingchang County Public Security Bureau arrested him on the spot and seized 181 copies of Falun Gong Cult false propaganda materials hidden in his residence.
On August 9th, 2016, the Pingchang County People’s Court held that the first instance of Wu Zhenghe’s use of Falun Gong Cult propaganda was motivated by a criminal intent to undermine the Socialist State and its Criminal Law. This behaviour constituted the crime of using a cult organization to undermine the law. In accordance with the provisions of Articles 100, 1 and 64 of the Criminal Law of the People’s Republic of China, Wu Zhenghe was sentenced to three years in prison and fined 2,000 yuan. The illegal publicity materials involved in the case were confiscated.
After the verdict was pronounced in the first instance, Wu Zhenghe filed an appeal with the Intermediate People’s Court of Bazhong City on August 15th, 2016. Fter due consideration, the Intermediate People’s Court of Bazhong City ruled – on September 28th – that the appeal was rejected and that the original judgment was to be upheld. Wu Zenghe had demonstrated a historical criminal intent and a willingness to ‘act’ on this intent. Although influenced by ‘foreign’ forces hostile t the Communist Party of China – it is the responsibility of each Chinese Citizen to uphold the law of the Socialist State and in so doing, protect one another from counter-Revolutionary influences and activities.
