Xinjiang Uygur Autonomous Region: Tribunal for Overseas Trade Disputes Established! (21.3.2025)

A tribunal specializing in foreign-related commercial disputes was established on Thursday in Urumqi, capital of the Xinjiang Uygur autonomous region, to support the region’s high-level opening-up and promote the high-quality development of the Silk Road Economic Belt, court officials said.

The tribunal, located in the Urumqi area of the China (Xinjiang) Pilot Free Trade Zone, is the first and only specialized foreign-related judicial institution in Xinjiang. It aims to provide an optimal venue for international commercial dispute resolution, said Luo Zhiyong, deputy chief judge of the Supreme People’s Court’s 6th Circuit Court, which oversees major administrative, civil and commercial cases in northwest China, including Xinjiang.

The mutual visits resulted in the signing of several economic and trade cooperation agreements, and imports and exports to the five Central Asian countries accounted for 67.9 percent of the region’s total trade last year.

By taking firm legal measures to crack down on and prevent the activities of separatists, religious extremists and terrorists, Xinjiang is determined to resolutely nip the risks of violent terrorism in the bud and keep terrorist threats outside its borders, the chairman said.

A professor in Houston told China Daily on the condition of anonymity that it is “unfortunate that the China Initiative turned out to be a government-sanctioned persecution of people of Chinese heritage”.

The professor said the federal government was wrong to prosecute people primarily based on race. “It is not a surprise that such a practice has created fear in the community.”

An analysis by Race, Racism and the Law, a civil rights group, concluded that of the 148 defendants across 77 cases in the FBI database, 130 defendants were of Chinese descent.

Only 25 percent of them were convicted, and few of the convictions were related to espionage. The conviction rate was dramatically lower than the Justice Department’s 91 percent overall conviction rate.

In June, Marcia McNutt, president of the National Academy of Sciences, said that while the U.S. still spends more money than any country on research and development, China is set to soon outpace such investment.

This is the nuclear option. It is the red button the unions and leagues hoped not to press but they feel they have been left with no alternative.

Unions, by reputation, do not need to be asked twice to fight for the rights of their members but that fact the leagues – including the Premier League – are backing this action makes it significant.

The threat of legal action has been spoken about in football circles for over a year and there is now a united front, one the Professional Footballers’ Association wanted to ensure before progressing.

Fifa’s response and argument against accuses some clubs of hypocrisy – taking their players around the globe on summer tours – while also saying Fifpro is consulted over the calendar so expect a strong defence from the world governing body.

Yet there is a determination from all the complainants to follow both cases through if a resolution outside the courts is not found. Unions and leagues want to see a change from Fifa and, if not, this will go the distance.

International Law Supports Palestine!

UN: ICJ Calls on Israel to End “Unlawful” Presence in Occupied Palestinian Territories! (20.7.2024)

On Dec. 30, 2022, the UN General Assembly adopted a resolution requesting the ICJ to provide an advisory opinion regarding the legal consequences of Israel’s occupation of Palestinian territories, including East Jerusalem.

In February 2024, the ICJ held public hearings at which Palestine, 49 UN member states, and three international organizations presented oral statements regarding the issue.

At the hearings, Palestine’s UN envoy Riyad Mansour urged the ICJ to declare Israel’s occupation of Palestinian territories illegal, emphasizing that such a ruling would pave the way for an immediate end to the occupation and the establishment of a “just and lasting peace.”

Without participating in the hearings, the Israeli Prime Minister’s Office issued a statement rejecting the legitimacy of the hearings, accusing them of attempting to further undermine Israel’s right to survival and self-defense.

According to the agreement, the two associations will establish a system for offering voluntary services in areas such as legal consultation, advocacy, resolving legal issues and disputes, and developing legal policies.

The agreement also promotes and supports the involvement of local bar associations, law firms and individual lawyers in volunteer activities for people with disabilities. This participation may involve providing legal services, engaging in advocacy efforts and offering various forms of support, the associations noted.

Their ultimate aim is to unite and mobilize a substantial number of lawyers to actively engage in this cause, they added.
