The ruling marks a rare appellate intervention in the context of pre-nuptial agreements. Lady Justice King stressed that the court’s conclusion should not be seen as undermining Radmacher, nor as any shift in the law: “So long as there is no statutory scheme, Radmacher will continue to bind this court. […] Pre-nuptial agreements are about the autonomy of the parties to determine for themselves what should be the fair outcome in the event that their marriage fails.” However, the judge continued, where the parties themselves set out a disclosure regime in the agreement, any deliberate misrepresentation of that disclosure – particularly when induced by one party – is liable to vitiate the agreement. “[W]ilful or fraudulent breach of that agreement […] is entirely different from the position in Radmacher,” she concluded.

Beijing Imposes Sanctions on Ex-U.S. Lawmaker – Mike Gallagher! (22.5.2024)

Observers noted that Gallagher has been among junior members of Congress that frequently participate in negative narratives blasting China, so as to climb higher in their political careers.

Since 2017, he has proposed a slew of China-related bills, and The Associated Press called him someone who “has spearheaded House pushback against the Chinese government”.

Last year, he proposed a bill seeking to block companies of China and other “foreign adversaries” from purchasing land near military bases and other sensitive sites.

Last month, Gallagher worked together with congressional fellows, including Representative Jimmy Panetta, on proposing a bill to impose sanctions on any Chinese military firm that provides material support to Russia.

Russia: Court Freezes J.P. Morgan Funds! (25.4.2024)

In response, J.P. Morgan filed a lawsuit against VTB, demanding an end to its request for the 440 million dollars. The claim was submitted to the federal court in Manhattan. J.P. Morgan asserted that VTB had agreed to the account management terms when it opened a correspondent account for transaction processing in 2008. Under the terms, the account would be governed by U.S. laws and could be frozen if required due to sanctions.

VTB was subjected to sanctions by the United States, Britain, and the EU in the spring of 2022. The sanctions involve asset freezes and a prohibition of transactions with these assets by individuals and legal entities from those countries.

The countermeasures consist of freezing the properties of those companies in China, including their movable and immovable property, and prohibiting organizations and individuals in China from transactions and cooperation with them, the spokesperson said.

“I would like to stress that the Chinese government remains unwavering in our resolve to safeguard national sovereignty, security and territorial integrity and protect the lawful rights and interests of Chinese companies and citizens,” said the spokesperson.

China urges the United States to abide by the one-China principle and the three China-U.S. joint communiques, observe international law and the basic norms governing international relations, stop arming Taiwan, and stop targeting China with illegal unilateral sanctions, the spokesperson said, noting that “otherwise there will be strong and resolute response from China.”
