British Mercenary Sean Pinner Appeals Death Sentence! (28.8.2022)

Sean Pinner was Accused of Being a ‘Sniper’ Instructor for the AFU. Sniping was Used Continuously Over the Last Eight-Years to Harass, Maim and Kill the Residents of Donbass!

Translator’s Note: I was surprised to find a ‘mixed’ reaction to the announcement of the Death Sentences handed down by the Supreme Court of the DPR upon the foreign mercenaries Aiden Aslin, Sean Pinner and Saadoun Brahim within the Ukrainian and Russian Telegram communities. Some welcomed these decisions whilst others were opposed, with a few being concerned about military repercussions from the West. (A common concern involved the idea of the UK ‘sending in’ the fabled ‘SAS’ into Donbass to wreak revenge – if indeed they are not already there). Many felt it set a bad example and that Russia and the DPR and LPR should rise above such petty revenge, etc. The overwhelming consensus, however, was that these sentences are political jockeying for position on the international scene and that all three criminals would be ‘exchanged’ as there are beneficial deals to be made for all sides concerned. At the very least, in the first instance, the Death Sentences will be ‘commuted’, or so the thinking goes. Considering the vicious nature of the aggression of the US, UK and EU in the Donbass region, and given the fact that the West has surrounded Russia with hostile ‘Neo-Nazi’ regimes, I am not so sure these sentences will be ‘commuted’ and that there is every possibility that they will be carried-out. This deadly action would both ‘match’ and ‘equal’ the logic underlying Russia’s decision to finally take military action against the aggression of the West and the Neo-Nazi regime that was brought to power in the Ukraine during early 2014! Indeed, not to ‘Execute’ these three men would be an ‘odd’ contradiction in the military logic adopted by the Russian Federation – almost a ‘weakness’ in policy – so to speak. Many ask why it is that ‘Saadoun Brahim’ – a Moroccan Citizen – has been tried with two British Citizens. Answers vary from Saadoun Brahim spending time in the UK (he certainly seems to possess a British accent) – to these men being the only three (early) examples of foreign mercenaries captured ‘alive’ by the Russians (and their Allies) during the fighting around Mariupol! Of course, other foreign mercenaries have since been captured alive (notably the Americans Alexander Druke and Andrew Hyun) – and we await developments in that direction. Whatever the case, these three condemned men had one-month to ‘Appeal’ their Death Sentences from the day they were handed down, in this instance June 9th, 2022. It is logical to assume that the lawyers of all three men will lodge a ‘Cassation Appeal’ before the deadline of July 9th, 2022, and that consequentially, each of the three condemned men will receive a guarantied two extra months of existence. This will take us to around the end of August, 2022, when the Supreme Court of the DPR will have to decisively ‘rule’ upon whether the original verdicts were ‘Just’ (and a correct interpretation of the law) or decide that they were not and ‘Overturn’ or ‘Vacate’ the Death Sentences. If the sentences are ‘Vacated’ – then the three cases may well be referred for retrial in a lower DPR Court. If the sentences are not ‘Overturned’ – then I suspect a definite date will be set for the ‘Executions’ to carried-out – and there is always a chance that they might be carried-out ‘immediately’ given all the previous delays! British mercenary Sean Pinner, who was sentenced to death for participating in hostilities in Ukraine as part of the Armed Forces of Ukraine, has ‘Appealed’ the verdict. On June 28th, 2022, the Supreme Court of the DPR received a Cassation Appeal from the mercenary’s lawyer.

The Court clarified that the Cassation Appeal (from the Latin ‘Cassare’ – the act of ‘cancelling’, ‘reversing’ or ‘overturning’ a Court Verdict) is considered no later than 2 months from the date the case is officially received by the Supreme Court of the Republic for consideration (In the case of Sean Pinner, the Cassation Appeal was received on the 28.6.2022).

“The date of the Cassation Hearing is set to take place no later than two months from the date of the Cassation Appeal being officially received by the Court for consideration (in accordance with Part 1 of Article 408 of the Code of Criminal Procedure of the DPR),” a TASS Report concluded.

Recall that on June 9th, 2022, British mercenaries Aiden Aslin and Sean Pinner, who participated in the hostilities on the side of the Armed Forces of Ukraine, as well as a citizen of the Kingdom of Morocco, Saadoun Brahim, were Sentenced to Death in the DPR, with the Court giving a month to Appeal the Sentence.

According to the Press Secretary of the President of the Russian Federation Dmitry Peskov – in fact, if London officially appeals against the verdict of the DPR Court on behalf of the mercenaries – this will imply the ‘de facto’ recognition of the existence of the ‘independent’ State of the Donetsk People’s Republic (DPR).

The official representative of the Russian Foreign Ministry, Maria Zakharova, said that Capital Punishment would serve as a “good example” for “soldiers of fortune” who took the side of the Ukrainian nationalists. The head of the DPR, Denis Pushilin, previously reported that the Charter of the Tribunal with regard to the mercenaries was at its final stage.

Британский наемник Шон Пиннер, приговоренный к смертной казни за участие в боевых действиях на Украине в составе ВСУ, обжаловал приговор. Кассационную жалобу адвоката наемника 28 июня получил Верховный суд ДНР.

В суде уточнили, что кассацию рассмотрят не позднее 2 месяцев со дня направления дела в инстанцию Верховного суда республики. 

“Дата кассационного рассмотрения назначается не позднее двух месяцев со дня направления дела в кассационную инстанцию (часть 1 статьи 408 УПК ДНР)”, – сказала собеседница ТАСС

Напомним, в июне участвовавшие в боевых действиях на стороне ВСУ британские наемники Эйден Аслин и Шон Пиннер, а также подданный Королевства Марокко Саадун Брагим были приговорены в ДНР к смертной казни, на обжалование приговора суд дал месяц. 

По словам пресс-секретаря президента РФ Дмитрия Пескова, фактически обжалование Лондоном приговора наемникам будет означать признание Донецкой Народной Республики.

Официальный представитель российского МИД Мария Захарова заявляла, что высшая мера наказания послужит для “солдат удачи”, занявших сторону украинских националистов, “наглядным примером”.

Глава ДНР Денис Пушилин ранее сообщал о том, что устав трибунала над наемниками находится на финальной стадии.
